United States Attorney Brendan V. Johnson announced that a Kyle, South Dakota, man has been indicted by a federal grand jury for entering an occupied structure, during the nighttime, on May 8, 2010, in Kyle, with the intent to assault a female with a tree branch.
Charles Blue Bird, a/k/a "Hokie", age 22, was indicted by a federal grand jury on April 19, 2011, for First Degree Burglary and Assault with a Dangerous Weapon. He appeared before United States Magistrate Judge Veronica L. Duffy on May 6, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is 25 years of imprisonment and/or a $250,000 fine. The charges are merely accusations, and Blue Bird is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Bureau of Indian Affairs and the Oglala Sioux Tribe Department of Public Safety. Blue Bird was remanded to the custody of the U.S. Marshal. A trial date has been set for July 12, 2011. |
